By accessing or using FoxLAP, you agree to these Terms. If you do not agree, do not use the Services.
1. Scope and acceptance
These Terms apply to the FoxLAP website, user accounts, dashboards, track database, telemetry analysis, software, downloads, video overlay tools and any related service that links to these Terms (together, the “Services”). Additional terms may apply to purchases, third-party stores or specific paid features.
If you use the Services on behalf of an organisation, you confirm that you are authorised to bind that organisation. If you are a minor, you may use the Services only with the permission and supervision of a parent or legal guardian where required by law.
2. Accounts and security
You must provide accurate information, keep it reasonably up to date and protect your login credentials. You are responsible for activity performed through your account unless caused by a security failure attributable to us.
You must notify us promptly if you suspect unauthorised access. Accounts are personal and may not be sold, transferred, shared at scale or used to bypass access restrictions. We may require reasonable verification before restoring access or changing account information.
3. Acceptable use
You must use the Services lawfully and fairly. In particular, you must not:
- attempt to gain unauthorised access to accounts, systems, data or restricted functions;
- automate registrations, logins, password resets, scraping or requests in a way that abuses or disrupts the Services;
- circumvent security controls, rate limits, access restrictions or usage limits;
- upload malware, malicious code, unlawful content or data that infringes another person’s rights;
- probe, scan, reverse engineer or interfere with the Services except where such restriction is prohibited by mandatory law;
- use FoxLAP to harass, deceive, impersonate or harm another person;
- resell or commercially exploit access to the Services without our prior written permission.
4. Services, motorsport and telemetry
FoxLAP provides timing, positioning, sensor logging, circuit information, telemetry analysis and media tools. Measurements may be affected by satellite reception, sensor installation, calibration, device condition, track configuration, connectivity, imported data and other technical factors.
The Services are informational tools and do not replace driver judgement, official timing, vehicle inspection, safety equipment, track rules or instructions from organisers and officials. Motorsport is inherently dangerous. You remain responsible for safe driving, your equipment and compliance with applicable laws and circuit rules. Do not operate or adjust a device while driving when doing so would be unsafe.
5. User content and data
You retain your rights in telemetry files, videos, account information and other content you submit. You grant us a non-exclusive, worldwide and royalty-free licence to host, copy, process, convert and display that content only as reasonably necessary to provide, secure, maintain and improve the Services.
You confirm that you have the rights and permissions required to submit the content, including any personal data relating to drivers, passengers or other individuals. You are responsible for keeping your own backup copies of important files and sessions.
6. Intellectual property
The Services, FoxLAP name and branding, interfaces, software, designs, documentation, databases and original content are owned by or licensed to SAS Keerby Application and are protected by applicable intellectual property laws. Except for the limited right to use the Services under these Terms, no right or licence is transferred to you.
You may not copy, distribute, modify, sell or create derivative works from protected FoxLAP materials unless expressly permitted by us or by mandatory law.
7. Third-party services
The Services may interact with third-party products, maps, file formats, websites, payment services, stores or platforms. Their own terms and privacy rules may apply. We do not control third-party services and are not responsible for their availability, content or independent processing activities.
8. Availability and changes to the Services
We aim to provide reliable Services but do not guarantee uninterrupted, error-free or permanently available access. Maintenance, security incidents, internet failures, third-party outages or technical changes may temporarily affect availability.
We may update, improve, replace or discontinue features where reasonably necessary. When a material change adversely affects a paid service, any mandatory contractual or consumer rights remain applicable.
9. Suspension and termination
You may stop using the Services at any time and may request account deletion, subject to legal retention obligations and the conditions applicable to any active purchase or subscription.
In the event of abuse, fraud, unlawful conduct, a security risk, repeated violations or any material breach of these Terms, we may restrict, suspend or terminate access to a feature, the Services or an account. Where appropriate, we may act immediately to protect users, data, infrastructure or third parties. Otherwise, we will normally provide notice and a reasonable opportunity to remedy the issue.
10. Warranties and liability
The Services are provided with reasonable care and skill. To the extent permitted by law, we do not guarantee that telemetry, timing, track information, calculations, imported data or generated media will always be complete, accurate or suitable for a particular purpose.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including applicable consumer protections. Subject to those mandatory rules, we are not liable for indirect or consequential loss, loss of opportunity, loss of data that you could reasonably have backed up, or damage resulting from unsafe use, incorrect installation, third-party services or use contrary to documentation and track rules.
11. Privacy, cookies and Google Analytics
We process personal data to operate accounts, provide the Services, maintain security, respond to requests and meet legal obligations. Detailed information about purposes, legal bases, retention periods, recipients and your data protection rights should be provided in our privacy and cookie information.
We use Google Analytics to understand website traffic and improve usability. Depending on its configuration, Google Analytics may process information such as pages viewed, interactions, device and browser information, approximate location and identifiers stored in cookies or similar technologies. Where applicable law requires consent, Google Analytics must only be activated after valid consent. Users must be able to refuse or withdraw consent as easily as they give it.
12. Changes to these Terms
We may update these Terms to reflect changes to the Services, law, security practices or our business. The updated version will be posted on this page with a revised date. For material changes affecting registered users, we may provide additional notice where reasonably possible or legally required. Continued use after the effective date constitutes acceptance, except where express consent is required by law.
